What have people heard or read about this? I've just had a quick look around and it seems that James still hasn't confirmed. I read that he will only be in half the episodes.
As much as the news about Dan and possibly Chris returning has excited me, I'll be bummed if there really will be a lack of Nathan in the last season...

When "One Tree Hill" fans were rallying for a Season 9 pickup, veteran cast members like Sophia Bush and Bethany Joy Galeotti proudly announced that they'd renewed their contracts for one final season on the long-running drama. When The CW finally announced that they were granting the show an abbreviated ninth season, the one cast hold-out remained James Lafferty. Now, details are emerging about the actor's reduced role. We've confirmed that James Lafferty will be listed as a series regular, just as he always has been. However, TVLine reports that despite the title remaining the same, Lafferty will appear in only about half of the 13 episodes. Word is that Lafferty's character, Nathan, who is now a full-fledged Fortitude agent, will be traveling abroad for a significant chunk of the season. (Perhaps he'll visit his MIA brother, Luke!) Hmm I will miss him but since it will only be 13 episodes and he will be there for half I think I can handle it.
Is Chris Keller going to be coming back for Haley because if they do that again I don't know.
Now Dan returning is good to me he was gone for far to long. Overall I think Nathan should be there but if they give us some good scenes with him and Dan along with everyone else and it works I will be okay.
